Financial Settlement.

In cases of claims where Hong Kong Government has a clear-cut legal liability under Hong Kong Defence (Compensation) Regulations there can of course be no alternative to meeting claims (see paragraph 2 (iv) of my Despatch No. 15 Secret of 17th March).

The note referred to in my telegram No. 785 was des- patched on 3rd June as my priority savingram No. 83 Secret. It indicates the basis on which H.M.G. decides which claims it will meet and thus indicates the types of claims in respect of which H.M.G. is standing behind the Hong Kong Government under the terms of the financial settlement

3. From the Allen Report it does not seem that any cases will arise in which there will be conflict between the criteria set out in paragraph 1 above and those referred to in paragraph 2 above.

440 In your telegram No. 542 you said that you would consult H.M.G. if any cases should arise in which you would wish to meet claims which H.M.G. would not themselves meet and you will no doubt also consult H.M.G. in the unlikely event of the expectations expressed in paragraph 3 above proving

incorrect.
